Work Disconnection Policy
OBJECTIVE
To establish the guidelines through which Kreston Colombia guarantees the right to work disconnection, in compliance with Law 2191 of 2022 and other provisions in force in Colombia, promoting balance between work, personal and family life, as well as the prevention of psychosocial risks associated with work overload and the permanent use of digital media.
SCOPE
This policy applies to all Kreston Colombia employees, regardless of their engagement modality (on-site, remote, hybrid or on assignment), and to all business units nationwide.
In accordance with current regulations, managerial, trust and management employees may fall within the established legal exceptions, without this implying disregard for the principles of balance and respect for rest time.
POLICY DESCRIPTION
Kreston Colombia recognizes work disconnection as a fundamental right aimed at ensuring the effective enjoyment of rest time, vacations, leave and permits, as well as fostering a balance between personal, family and work life.
The organization will promote a culture of respect for working hours and will avoid practices that generate repeated contact outside the ordinary working day, except in duly justified exceptional situations.
General Provisions
In compliance with Law 2191 of 2022 and related regulations, the following guidelines are established:
Kreston Colombia employees and the companies with which they work on assignment shall enjoy the right to work disconnection, which begins once the working day ends.
Employees have the right not to respond to calls, messages, emails or other digital means outside their working hours, during weekends, holidays, vacations, leave or permits.
Leaders and managers must refrain from making requests outside working hours, except in cases of force majeure, unforeseen situations, or when there is a significant risk to operations.
When, for operational reasons, it is necessary to send communications outside working hours, the delayed-send scheduling of emails or other available technological tools must be used whenever possible.
Kreston Colombia employees undertake to make appropriate use of the digital media used for their work, avoiding using them for work purposes outside their working hours.
No sanction, retaliation or negative evaluation may be imposed as a result of the legitimate exercise of the right to work disconnection.
Exceptions must be duly justified and respond to criteria of necessity, urgency or continuity of service.
Receipt and processing of complaints
When an employee considers their right to work disconnection has been violated, they may file a formal complaint via email at comite.convivencia@kreston.co.
The complaint will be processed in accordance with the KRM-CAL-PD-006 Requests, Complaints, Claims and Applications (PQRS) Procedure.
The employee must complete the corresponding form KRM-CALF-010, available in the Hemma Management and Information System.
The Workplace Coexistence Committee will ensure:
– Confidentiality of the process.
– Objective analysis of the case.
– Timely response.
– Implementation of corrective actions when applicable.
Respect for the right to work disconnection is a commitment that strengthens sustainable productivity, organizational well-being and regulatory compliance. Failure to comply with this policy may give rise to the corresponding disciplinary actions, in accordance with current internal and legal regulations.
